Criteria for the Employment of Foreign Personnel for Tourism Sector


New Regulation for Foreigners to Work in the Tourism Sector by The Ministry of Labor and Social Security (MoLSS) provided convenience to the base wage levels and employment criteria to be paid to foreigners who will work in the tourism sector until 31.12.2016 in order to support the tourism sector, which has been adversely affected by regional events in 2016. Accordingly, the Ministry of Labor and Social Security announced on 14.02.2017 that it would continue to increase the additional facilities in 2017 as a result of requests from the sector representatives. The amendment is as follows:

Foreigner Employment Requests in the Tourism Sector;


Tourism facilities with at least three stars certified by the Ministry of Culture and Tourism, certified holiday villages, thermal hotels with permission from official authorities that can prove they have authorised massage parlours,

Contracted tourism facilities which have agreements for complexes such as Hamam-sauna-SPA etc.,

Sports centres authorised by official authorities that employ at least 20 Turkish citizens,

Requests for foreign employment in the jobs requiring expertise and proficiency, such as masseurs, masseuses and SPA therapists, will be considered, and the demands of businesses and workplaces that are not within this scope shall be deemed inappropriate.

The minimum wage level that can be paid to the foreigners for the foreigners who will work in the certified entertainment establishments (SPA, beauty center, sports center, hairdresser, jeweller, leather, carpet, textile, and other small businesses), tourism travel agencies, certified holiday villages and tourism-animation organisation companies and in the independent entertainment places within the body of the Ministry of Culture and Tourism with their certified or non-certified tourism establishments and as of the date of application can be applied as minimum wage.

For foreigners to be employed in jobs that require expertise and proficiency in tourism companies certified by the Ministry of Culture and Tourism along with certified holiday villages, the entertainment sector, tourism-animation organisation companies must employ at least 10 Turkish citizens,

In the event that at least one Turkish citizen is employed for foreigners who will be employed in enterprises (small businesses such as hairdressers, jewellers, leather, carpets, textile sales etc.) that are authorised or contracted by the Ministry of Culture and Tourism for the employment of certified or undocumented tourism establishments, there shall be no more than two foreign employees and in this event the quota of at least five Turkish employees per foreign employee shall not apply.

Social security contributions Provided that the provisions of the bilateral social security agreements are reserved for foreigners whose work permits are obtained, SSI premiums must also be paid. Social security contributions of foreigners should be notified to the Social Security Institution 30 days per month according to the fee declared to the ministry when obtaining a work permit.
